同普通使用的英语词一样，法律英语里也有一词多义的现象。在英语词典里，一个词条下，可以给出多达二十几个词义（如常用词take）；但一个词在具体上下文中，只能有一个特定的意义。译者要理解和翻译的就是“这一个”意义。例如，good一词在法律文件中，有各种各样的意思，但几乎无一处可以用一个“好”

字来翻译。A good contract系指“有效合同”，复合词goodwill不表示“善意”，而是公司或企业的“商誉”。下面，再看看以good构成的词组，注意各自的意思和翻译：

(1) Neglect of duty is good cause for removal of a trustee.

理事玩忽职守，理应接触其职务。

“good cause”表示a legally sufficient reason （“法律上有充分理由”）。

(2) The Vendor shall procure that the Purchaser acquires good title to the Shares free from all charges, liens, encum-branches, equities and claims whatsoever.

卖方应保证买方获得不容置疑的股份所有权，且该等股份不带任何押计、留置、负担、权益和主张。

“good title”是指title that is legally valid and effective （“法律上有效的所有权”，亦可译成“无可争辩的所有权”）。

(3) Now therefore, in consideration of the premises, and the representations, warranties, covenants, and undertakings of the parties hereinafter set forth, and for other good and valuable consideration, the parties agree among themselves as follows.

鉴于上述事实个各方在下文所作的陈述、保证、立约和承诺，及其他有效的有价约因，现各方达成协议如下。

“good consideration”系consideration that is valid under the law （“法律上有效的约因或对价”）。有时候，good consideration等同于valuable consideration, good和valuable还可以连用，表示同意意思。这里分别译出，以示区别。

(4) Party A is a company duly organized, validly existing and in good standing as a legal person under the laws of the PRC.

甲方是依据中国法律正式成立、有效存续和资格完备的法人公司。

“in good standing”表示是符合法律法规要求的，是有资格的。

(5) If any term or provision of this Agreement shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be severed from this Agreement shall be deemed to be deleted from this Agreement, provided that if such deletion materially affects or alters the basis of this Agreement, the parties shall negotiate in good faith to amend and modify the provisions and terms of this Agreement as may be necessary or desirable in the circumstances.

如果因任何原因本协议的任一条款或规定变为或被宣布为不合法、无效或不可执行，该条款或规定须与本协议分离，且被视为从本协议中删除，但如果删除该条款或规定会实质性影响或改变本协议的基础，双方应以诚信的态度进行谈判，以期在必要或可取的情况下对本协议的规定和条款进行修改和变更。

“good faith”的意思是honesty, fairness and lawfulness of purpose，相当于汉语里的“诚信”，译文加了“态度”，使之具体化，符合汉语的表达方式。

一词多义的关键，在于准确理解该词在具体语境中的意思，只有这样才有可能选用恰当的汉语词来翻译。

2、一词多译

    一个多义词的翻译，取决于该词在上下文中的特定意思，这在上面一节已有介绍。这里要讲的是，从翻译角度上看，即使是在上下文中只表示同一个意思的词，由于与其后面的词搭配不同，也需要按照汉语词的搭配习惯译成多个不同的词，如：

（1）The Amendments include provisions for freedom of speech, of the press and of worship; the right of citizens to meet peacefully; the right to be secure in one’s own home against unreasonable searches and seizure of persons or property; and the right of any person charged with breaking the law to have a speedy trial by a jury of fellow citizens.

修正案条款中规定言论、新闻和信仰自由，公民有和平集会的权利，有在自己家里享有安全、人身不受无理搜查和逮捕、财产不受无理查抄的权利，以及任何人被指控犯罪时享有公民陪审团及时审理的权利。

    在这个句子结构中，“searches and seizure of persons or property”是简洁而又通顺的短语，因为search (v.)和seize都可以带宾语person and property，故而压缩掉一个相同的宾语。然而，如果照直译成汉语，“搜查和逮捕人身”说得通，“搜查和逮捕财产”则说不通，“搜查和没收人身”也说不通。翻译这个短语，涉及汉语词与词的搭配问题，必须把seizure译成两个不同的词，涉及汉语词与词的搭配问题，必须把seizure译成两个不同的词，才能准确通顺地表达原义。“seize”(seizure n.)在这里作“take into custody”讲，与person搭配，可译为“拘捕”、“逮捕”；与property搭配，可译为“扣押”、“没收”。这样，seizure of persons and property 便可译成“（人身不受无理）逮捕、（财产不受无理）查抄”。

     同样是出于汉语词语搭配的考虑，下面这个句子里的动词make分别译成了三个不同的词：

(2) None of the Parties shall be entitled to make or permit or authorize the making of any press release or other public statement or disclosure concerning this Agreement or any of the transactions contemplated in it, without the prior written consent of the other Parties, save as required by law or other competent authority.

未经其他各方事先书面同意，任何一方均无权就有关本协议或本协议预期的任何交易举行新闻发布会、发表公开声明或进行披露，亦无权允许或授权他人进行此等发布或披露，法律或其他主管部门要求的除外。

    这里make a press release 的汉译应该是“举行（召开）新闻发布会”、发表公开声明或进行披露，亦无权允许或授权他人进行此等发布或披露，法律或其他主管部门要求的除外。

这里make a press release的汉译应该是“举行“召开”新闻发布会”，make a public statement应译成“发表公开声明”，而make disclosure则是“进行披露”。

由此可见，一个英语词在特定的上下文里，需要按照汉语的搭配习惯分别译成两个或两个以上不同的词，方能使译文自然地道。
